Agreement to These Terms
These Terms of Service (“Terms”) govern your access to and use of capitalupfitters.com (the “Site”) and any services performed by Capital Auto Upfitters & Protective Coatings (“Capital Upfitters,” “we,” “us,” or “our”). By using the Site or requesting a quote, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
Who We Are
Capital Upfitters is a family-owned vehicle upfitting and protective-coating shop based in Rockville, Maryland, serving retail, fleet, dealer, government, and industrial customers throughout the DMV.
Use of the Site
You may use the Site for lawful purposes only. You agree not to:
- Interfere with or disrupt the Site, its servers, or connected networks.
- Attempt to access accounts, systems, or data you are not authorized to access.
- Submit false, misleading, or fraudulent information through any form.
- Use automated tools to submit forms, scrape content, or overwhelm the Site.
- Reproduce, distribute, or create derivative works from Site content without written permission.
Quote Requests, Estimates, and Appointments
Prices, timelines, and availability shown on the Site or provided in response to a quote request are estimates only until confirmed in a written work authorization or invoice. Final pricing depends on vehicle inspection, parts availability, actual condition of the vehicle, requested options, and prevailing rates at the time work is scheduled. Submitting a quote request does not create a contract or reserve shop time.
Appointments are subject to availability. We reserve the right to reschedule work when necessary due to parts delays, weather, or shop capacity.
Work Authorization and Payment
Work is performed only after you sign a written work authorization identifying the vehicle, services, parts, and price. Payment is due upon completion unless other terms are agreed in writing. We accept the payment methods identified at the shop. Vehicles left after the invoice due date may be subject to storage fees consistent with Maryland law.
Parts, Products, and Manufacturer Warranties
We install parts and coatings from third-party manufacturers, including but not limited to Patriot Liner, IGL Coatings, System X, Weatherguard, Kargomaster, Rhino-Rack, DECKED, Ranch Hand, and others. Those parts and coatings carry manufacturer warranties, which are provided by the manufacturer and are governed by the manufacturer’s terms. Capital Upfitters is not the manufacturer and does not guarantee the performance or durability of third-party products beyond the applicable manufacturer warranty.
Our Workmanship Warranty
We warrant our installation workmanship against defects for the period stated on your invoice or as otherwise agreed in writing at the time of service. This warranty covers installation errors and does not cover:
- Damage caused by accident, misuse, off-road impact, collision, or negligence.
- Damage from vehicle modifications made by others after our work.
- Ordinary wear, fading, oxidation, or environmental damage.
- Failure caused by improper cleaning, chemicals, or aftermarket coatings applied after our work.
Warranty claims must be submitted in writing to the address below, accompanied by the original invoice and photographs of the issue.
Vehicle Condition and Pre-Existing Damage
You represent that you own the vehicle you are having serviced, or are authorized to have it serviced on the owner’s behalf. We document vehicle condition at intake. You are responsible for removing personal property from the vehicle before drop-off; we are not responsible for personal items left inside.
Fleet, Dealer, Government, and Industrial Programs
Program pricing, purchase-order terms, invoicing schedules, and net-payment periods for fleet, dealer, government, and industrial customers are set out in a separate program agreement. In the event of a conflict between these Terms and a signed program agreement, the program agreement controls.
Communications
By submitting a quote, callback, or contact form, you consent to receive project-related communications from us by email, phone, or SMS at the contact information you provide. Standard message and data rates may apply. You may opt out at any time by replying STOP to an SMS or contacting us directly.
Intellectual Property
All Site content, including text, logos, photos, videos, layouts, and code, is owned by Capital Upfitters or its licensors and is protected by U.S. and international intellectual-property laws. You may not reproduce, republish, or resell any Site content without prior written permission, except for personal, non-commercial use.
Third-Party Links
The Site may link to third-party websites (for example, manufacturer pages, Google Business Profile, review platforms, or the customer portal). We are not responsible for the content, privacy practices, or availability of third-party sites.
Disclaimers
The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Capital Upfitters disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, with respect to Site content. Services performed on your vehicle are governed by the written work authorization and our workmanship warranty described above.
Limitation of Liability
To the fullest extent permitted by law, Capital Upfitters’ total liability arising out of or related to the Site or any services performed shall not exceed the amount you paid us for the services at issue. In no event will Capital Upfitters be liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless Capital Upfitters and its owners, employees, and contractors from any claims, damages, or expenses arising from your misuse of the Site, breach of these Terms, or violation of applicable law.
Governing Law and Venue
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-laws principles. You agree that any dispute arising from these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in Montgomery County, Maryland, and you consent to personal jurisdiction there.
Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top of the page reflects the most recent change. Continued use of the Site after an update constitutes acceptance of the new Terms.
